David Andrew Kirkland Sentenced to a Year and a Day in Federal Prison



David Andrew Kirkland, the former Director of the now defunct Birmingham, Alabama-based Adams Produce Company LLC, has been sentenced by US District Court to serve a year and one day in federal prison for his plea to conspiracy to defraud the government on contracts for fruits and vegetables. In addition, he was also ordered to serve three-years' probation once he is released, according to AL.com.



Kirkland and five other men were charged in relation to a fraud scheme at Adams Produce. They were charged in a scheme to create false records that showed a higher cost for fruits and vegetables than was actually paid. It was alleged that enlarged costs were then presented to the US Federal Government, which had agreed to pay a certain amount over cost.

It was also reported that Kirkland and his co-defendants were collectively ordered to pay $481,000 to the Defense Supply Center in restitution for his crimes.

Adams Produce was a produce company that was more than 100 years old. In the wake of the scandal, the company filed for re-organization under Chapter 11 in federal bankruptcy court in April, 2013, and ceased operations.
